Terms of Service

By accessing or using RSVPconcepts ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

RSVPconcepts provides an online event management platform that allows users to create event pages, collect RSVPs, manage guest lists, process ticket and destination booking payments, coordinate travel logistics, and communicate with guests. The Service includes both free and paid tiers, as well as per-event and per-feature add-on purchases. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. RSVPconcepts is not liable for any losses arising from unauthorized account use.

You agree not to use the Service to:

• •Create events for illegal, harmful, deceptive, or fraudulent purposes
• •Collect RSVPs or payment for events you do not intend to hold
• •Harass, abuse, or harm other users or guests
• •Upload or distribute spam, malware, or malicious code
• •Scrape, crawl, or systematically extract data from the platform
• •Impersonate any person or entity or misrepresent your affiliation
• •Violate any applicable laws or regulations
• •Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate these policies without prior notice.

You retain ownership of all content you upload, post, or submit to the Service ("User Content"), including event descriptions, photos, and guest data. By submitting User Content, you grant RSVPconcepts a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content solely to provide and improve the Service. You represent and warrant that your User Content does not violate any third-party rights or applicable law.

When you collect RSVPs, you gather personal information from your guests (name, email, phone, dietary restrictions, etc.). You agree to:

• •Use guest data only for the purpose of managing your event
• •Not sell, share, or repurpose guest data without their consent
• •Comply with all applicable data protection laws (including GDPR where applicable)
• •Delete guest data upon request from the guest or as required by law

RSVPconcepts processes guest data on your behalf as a data processor. For events using ticket sales or destination booking features, RSVPconcepts also processes payment data as required to fulfill transactions. Please refer to our Privacy Policy for details on how we handle data.

RSVPconcepts offers the following payment products:

• •Subscription Plans (Pro and Business): Billed monthly or annually via Stripe. By subscribing, you authorize recurring charges until you cancel. Cancellation takes effect at the end of the current billing period.
• •Per-Event Premium Upgrade ($5): A one-time PayPal purchase that unlocks premium features (ad removal, unlimited guests, QR check-in, exports) for a single event.
• •Destination Events Add-On ($25): A one-time Stripe purchase that activates booking tools, travel management, and guest payment processing for a single event (90-day access).
• •Ticket Sales (Business plan): Event hosts can charge guests for event entry via Stripe Connect. Funds are transferred directly to the host's connected Stripe account.
• •Destination Guest Payments: Guests pay for travel packages (hotels, flights, excursions) through Stripe. Supports deposits, installment plans, and multi-currency checkout.

All fees and charges are in USD unless otherwise specified. You are responsible for any taxes applicable to your purchases.

RSVPconcepts processes payments through Stripe and PayPal. For ticket sales and destination guest payments, RSVPconcepts acts as a payment facilitator using Stripe Connect — the event host is the merchant of record for their transactions.

• •Platform Service Fee: RSVPconcepts charges a platform fee on ticket sales and destination guest payment transactions. The current rate is disclosed at checkout and is subject to change with 30 days' notice.
• •Stripe Processing Fees: Standard Stripe processing fees (2.9% + $0.30 for US cards, varying for international cards) are applied by Stripe directly and are not controlled by RSVPconcepts.
• •PayPal Processing Fees: Standard PayPal processing fees apply to per-event premium upgrades and are not controlled by RSVPconcepts.
• •Fee Allocation: The platform fee and processing fees may be borne by the host or the guest, as configured by the event host in their event settings.

RSVPconcepts does not store credit card numbers. All payment data is handled directly by Stripe and PayPal in compliance with PCI DSS standards.

RSVPconcepts maintains a structured refund policy with specific terms for each payment product type:

• •SaaS Subscriptions (Pro/Business): Refundable within 7 days of initial purchase if premium features have not been materially used.
• •Per-Event Premium Upgrades ($5): Refundable within 48 hours of purchase if no guest payments have been processed and the event date has not passed.
• •Destination Events Add-On ($25): Refundable within 72 hours of activation if no guest bookings or payments have been processed.
• •Guest Booking Payments: Refund eligibility is governed by the event host's stated cancellation policy. RSVPconcepts does not determine guest refund eligibility.
• •Platform Service Fees: Non-refundable once the underlying transaction has been processed.

If you have a concern about a charge from RSVPconcepts, you agree to contact us at support@rsvpconcepts.com before initiating a chargeback or payment dispute with your bank or card issuer. We are committed to resolving billing issues promptly and can usually address concerns within 1 business day.

• •You agree to cooperate with RSVPconcepts in providing information and evidence related to any payment dispute
• •RSVPconcepts reserves the right to suspend or terminate accounts involved in fraudulent or abusive chargeback filings
• •If a chargeback is filed and subsequently determined to be fraudulent or without merit, you may be liable for associated chargeback fees and administrative costs
• •For guest booking disputes, the event host is responsible for resolving the underlying issue with their guest per their stated cancellation policy

When using ticket payment, destination booking, or guest payment features, event hosts assume additional responsibilities:

• •You act as the merchant of record for guest transactions processed through your events — RSVPconcepts facilitates the payment but is not a party to the transaction between you and your guests
• •You must set an accurate and enforceable cancellation policy for your event before accepting guest payments
• •You are responsible for communicating refund eligibility, cancellation terms, and event changes directly to your guests
• •You must fulfill the event and services as described — collecting payment for events or services you do not intend to deliver constitutes fraud and will result in account termination
• •You are responsible for all applicable taxes on revenue you receive through the platform
• •RSVPconcepts is not liable for disputes between hosts and guests regarding event quality, cancellations, or refund eligibility

RSVPconcepts supports multi-currency transactions for destination guest payments. By using these features, you acknowledge:

• •Exchange rates are provided at the time of checkout and may differ from rates at the time of settlement or refund
• •RSVPconcepts is not responsible for exchange rate fluctuations between the time of payment and the time of refund, settlement, or payout
• •All refunds are processed in the original payment currency
• •Host payouts are settled in the host's configured currency — exchange rate differences between the guest's payment currency and the host's settlement currency are handled by Stripe
• •Currency conversion fees charged by the guest's bank or card issuer are outside RSVPconcepts' control

The Service and its original content (excluding User Content), features, and functionality are owned by RSVPconcepts and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software without our express written permission.

RSVPconcepts acts as a data processor on behalf of event hosts (data controllers) for guest data collected through the Service. The following applies:

• •Guest data is stored in the United States using Supabase infrastructure (hosted on AWS)
• •Sub-processors used by RSVPconcepts include: Supabase (database and authentication), Stripe (payment processing), Resend (transactional email), Twilio (SMS notifications), and Vercel (hosting and edge delivery)
• •Guest data is retained for 12 months after the event date, after which it may be automatically deleted unless the host explicitly requests an extension
• •Event hosts may request deletion of all guest data associated with their events at any time by contacting support@rsvpconcepts.com
• •RSVPconcepts implements industry-standard security measures including encryption at rest and in transit, role-based access control, and regular security audits

For users subject to GDPR, RSVPconcepts offers a Data Processing Agreement (DPA) upon request. Contact privacy@rsvpconcepts.com for details.

RSVPconcepts targets 99.5% uptime for the Service, measured on a monthly basis. This is a target, not a guarantee.

• •Planned maintenance windows will be communicated at least 24 hours in advance via email to users with active paid subscriptions
• •RSVPconcepts does not offer Service Level Agreement (SLA) credits for downtime
• •In the event of extended unplanned downtime (exceeding 24 consecutive hours), affected paid users may request a billing adjustment by contacting support@rsvpconcepts.com

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. RSVPconcepts does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Service is at your sole risk.

To the fullest extent permitted by law, RSVPconcepts and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or goodwill — arising from your use of or inability to use the Service, even if RSVPconcepts has been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising from these Terms or the Service shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to RSVPconcepts in the six months preceding the claim.

You agree to indemnify and hold harmless RSVPconcepts and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) any dispute between you and a guest or attendee of your event.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Active subscriptions will be canceled but not refunded unless eligible under our Refund Policy. Provisions that by their nature should survive termination (including ownership, disclaimer of warranties, limitation of liability, and indemnification) shall survive.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, please discontinue use of the Service.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms that cannot be resolved through good-faith negotiation shall be subject to binding arbitration administered under the rules of the American Arbitration Association (AAA). The arbitration shall take place in the United States, and the decision of the arbitrator shall be final and binding. Either party may seek injunctive relief in a court of competent jurisdiction for matters requiring immediate equitable relief.
